1. Acceptance of Terms
By accessing or using Legacy Keeper ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.
2. Description of Service
Legacy Keeper is a digital estate planning platform that allows users to organize, store, and manage estate-related documents, assets, beneficiary designations, and end-of-life instructions. The Service includes tools for coordinating with professional advisors and designated beneficiaries.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized access.
4. User Responsibilities
You agree to use the Service only for lawful purposes. You are solely responsible for the accuracy and legality of the information you store in your vault. Legacy Keeper is not a substitute for professional legal, financial, or tax advice.
5. Data Ownership
You retain full ownership of all data you upload to Legacy Keeper. We do not claim any intellectual property rights over your content. You grant us a limited license to store, process, and display your data solely for the purpose of providing the Service.
6. Subscription and Billing
Paid features are billed on a monthly or annual basis as selected at the time of purchase. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. Refunds are handled on a case-by-case basis.
7. Limitation of Liability
Legacy Keeper is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
8. Termination
We reserve the right to suspend or terminate your account if you violate these terms. Upon termination, you may request an export of your data within 30 days. After 30 days, your data may be permanently deleted.
9. Changes to Terms
We may update these terms from time to time. Material changes will be communicated via email or a prominent notice on our website. Continued use of the Service after changes constitutes acceptance of the updated terms.
9A. Artificial Intelligence Services
9A.1 AI-Powered Features
LegacyKeeper offers the following optional AI-powered features, all of which are opt-in and disabled by default:
- GhostWriter — legacy letter generation
- Obituary Generator — AI-assisted obituary drafting
- Executor Copilot — estate task assistant
- Estate Risk Analysis — AI analysis of estate planning gaps and risks
- Raw Asset Parser — automated parsing of asset documentation
- Medical Summary (LifeLink) — AI-generated medical information summaries
- Document OCR — optical character recognition for uploaded documents
- Legal Document Audit — AI review of estate and legal documents
- Entity Extraction — automated identification of people, assets, and entities in documents
- Identity Conflict Detection — detection of inconsistencies across estate documents
9A.2 User Consent and Opt-In
AI features are opt-in and disabled by default. By enabling AI features in your account Settings, you consent to the processing of the relevant data categories (described in Section 9A.3) by Google Gemini, our AI service provider. You may enable or disable AI features at any time from your account Settings without affecting other Service functionality.
9A.3 Data Transmitted to AI Services
When you use AI-powered features, the following categories of data may be transmitted to Google Gemini for processing, depending on the specific feature used:
- Estate planning and financial data (asset details, beneficiary information, estate valuations)
- Legal document content (wills, trusts, powers of attorney, and similar documents)
- Medical and health information (as entered in LifeLink or related features)
- Personal identifiers (names, dates, relationships)
- Document images (uploaded documents processed via OCR)
- User-typed prompts and inputs submitted to AI features
Access credentials are not transmitted. Passwords, encryption keys, seed phrases, and other access credentials stored in your Digital Asset Vault are explicitly blocked from transmission to any AI service.
9A.4 Limitation of Liability for AI-Generated Content
AI-generated output — including letters, analysis, summaries, risk assessments, obituaries, and document reviews — is produced by third-party AI technology (Google Gemini) and does not constitute legal, medical, or financial advice. LegacyKeeper makes no representations or warranties as to the accuracy, completeness, or fitness for purpose of AI-generated content. LegacyKeeper is not liable for any inaccuracies, errors, or omissions in AI-generated content or for any decisions made in reliance on such content. Users should independently verify all AI-generated output with qualified legal, medical, or financial professionals before acting on it.
9A.5 Right to Disable AI Features
You may disable any or all AI features at any time by navigating to Settings › AI Features in your account. Disabling AI features will stop any future transmission of your data to AI service providers. Previously processed data is subject to Google’s data retention policies under the Gemini API Terms.
9A.6 Google Gemini API Terms
AI features are powered by Google Gemini. Your use of AI features is also subject to the Google Gemini API Terms of Service. We encourage you to review those terms before enabling AI features.
9A.7 GDPR Advisory — No Automated Decision-Making
AI features on LegacyKeeper are advisory tools only. No AI feature makes automated decisions with legal effect or similarly significant impact on you (within the meaning of Article 22 of the EU General Data Protection Regulation). All AI-generated output requires your review and affirmative action before any effect on your estate plan or account configuration.
10. Governing Law
These terms are governed by the laws of the State of New York. Any disputes shall be resolved in the courts located in New York County, New York.
